The goal pursued in the article is an explication of theoretical and methodological aspects of the legal gnosiology due to a pragmatic attitude to the world of social and legal relations. The novelty of the article is a substantiation of various types of social relations through legal interpretation of legal practice as a form of social technology that allows us to assert the independent nature of the legal gnosiology as distinct from a legal and philosophical gnosiology as part of the methodological self-reflection theory of law. The main conclusions substantiated in the article: - legal gnosiology includes practical understanding of the world of social and legal relations; - a commonplace, a professional (lawyer, manager), the theoretical understanding, which are different by status in the social and legal realities and by pragmatic attitude to it, are understanding of the basic types; - each type of categories of understanding and the resultant legal gnosiology has a different nature and origin. |
