The professionals who practice military career developed in the profession of arms within the various components of the Fuerza Armada Nacional Bolivariana which starts immediately after graduating from the various military institutes, go into retirement for various reasons. Among them are: the performance of service time, excess time in grade or application itself. It is worth mentioning that only those professionals who have over fifteen years of service may apply for voluntary retirements for various reasons, among which, medical conditions and time limit in the same grade. They are eligible for a pension that starts in sixty percent (60%), increasing steadily for years of service. Based on these considerations, the overall objective of this research is to determine the existence of the legal concept of the professional military retirement, compared with the termination of employment of a public official. To achieve this objective a study was done purely documentary, comparing and analyzing the existing legal instruments governing Venezuela work, retirement and military retirement.<br>Los profesionales que ejercen la carrera militar se desarrollan en el ejercicio de las armas dentro de los diversos componentes de la Fuerza Armada Nacional Bolivariana, la que se inicia inmediatamente después de egresar de los diferentes institutos militares, pasan a situación de retiro por diversas causas. Entre ellas se destacan: el cumplimiento de tiempo de servicio, exceso de tiempo en un mismo grado o propia solicitud. Vale la pena acotar que sólo aquellos profesionales que tengan más de quince años de servicio pueden solicitar su pase a retiro voluntariamente por diversas razones, entre las que destacan, circunstancias médicas y tiempo límite en un mismo grado. Ellos pueden optar a una pensión que parte del sesenta por ciento (60%), aumentando progresivamente por años de servicio. Sobre la base de estas consideraciones, el objetivo general de esta investigación es determinar la existencia de la figura jurídica de la jubilación en el profesional militar, comparándola con el cese laboral del funcionario público. Para alcanzar el logro de este objetivo se efectuó un estudio netamente documental, contrastando y analizando los diversos instrumentos jurídicos existentes en Venezuela que regulan el trabajo, la jubilación y el retiro militar. |
